The state should not discriminate. The benefits two partners get should be available to gays and lesbians. TCB: Well, it is the same. Whether you are a homosexual or heterosexual man, the state will not recognize a marriage to a man. California has extended civil union to same sex couple so as far as California is concerned the benefits are the same. The only difference is state recognition.
